Internet Free Speech Trial Wraps Up December
2006
Following
a four-week trial, the ACLU presented concluding arguments this
month in its long-standing challenge to Internet censorship law.
The law, now known as the "Child Online Protection Act" (COPA),
was signed by President Clinton in 1998 but has never been enforced.
The law as written would impose draconian criminal sanctions,
with penalties of up to $50,000 per day and up to six months imprisonment,
for online material acknowledged as valuable for adults but judged
"harmful to minors."
"Since Congress
passed this law, the Internet has changed and it is now clear
that this harsh, criminal law won't come close to achieving its
goals," said Chris Hansen, a senior staff attorney with the ACLU.
"It is also clear that other alternatives, including education
and filtering, are far more effective for those parents who want
to limit access by their children to certain websites using their
own values." The ACLU presented evidence from a broad range of
Internet speakers including online magazines, an online dictionary,
rap artists, painters and video artists, providers of safer sex
information and writers.
Attorneys
argued that the censorship law directly violates the First Amendment
rights of the ACLU’s plaintiffs and tens of millions of other
speakers to communicate protected expression on the Internet.
COPA represents Congress' second attempt to impose severe criminal
and civil sanctions on the display of protected, non-obscene speech
on the Internet. A first attempt, the Communications Decency Act
of 1996, was declared unconstitutional by all nine Justices of
the Supreme Court in Reno v. ACLU. "The constitutionally protected
right to freedom of speech applies to all mediums of communication,
including the Internet," said Hansen.
Think about
it this way, if a web site that sells adult sex toys says the
word toys, then that can be perceived as harmful to a minor to
lure them to the site.

Alabama focused
a new spotlight on some of the inherent absurdities in U.S. child
pornography and record-keeping laws. Indictments charge Marc Evan
Greenberg, 42, Jeffrey Robert Libman, 39, and Webe Web Corporation—all
of Ft. Lauderdale, Fla.—and teen glamour photographer Jeff Pierson,
43, of Brookwood, Ala., with conspiring to produce and distribute
child pornography via the Web.
On the surface,
the charges seem straightforward: however, the teens photographed
are fully clothed and are not doing anything sexual. Some courts
have held that any image that exposes a child’s genitalia—clothed
or nude—is lascivious; others have ruled lascivious images are
ones that seem designed to elicit a sexual response in viewers.
One court even noted “the motive of the photographer in taking
pictures may be a factor, since children are not necessarily mature
enough to project sexuality consciously, and thus, sexuality of
depictions often is imposed upon them by attitude of viewer or
photographer”

Adjust To Transgender Teachers December
2006
About 20
transgender teachers are working in classrooms nationwide, but
more are in the process of "transitioning," experts estimate.
That opens up a host of issues the teachers -- and their employers
and students -- have to deal with. "The question often arises:
Are transgender people competent to be employees, and those questions
can come from co-workers, management or students," said Chris
Daley, director of the Transgender Law Center in San Francisco.
"
"It's not
about acceptance, although that would be nice. It's about law
and policy, which states that it's illegal to discriminate against
someone on the basis of gender." Daley said the same rules apply
to transgender teachers as anyone else. "Just treat them like
you would any other employee," he said. "Give them a supportive,
comfortable work environment, and you won't have any problems."

Sex educators
in Germany are planning to launch a spray-on condom. The spray-on
condom would help people enjoy sex more while having safe sex.
The spray allows the user to insert his penis in the can which
then coats it with latex rubber with the push of a button. It
would be ready for use within five seconds of spraying and it
would be a more effective contraceptive than a regular condom
because it would fit better.
The new high-tech
condom likely would not be available until 2008, but once it hits
stores it will come in different colors, strengths and sizes.
The can would cost about $26 while the latex cartridges for the
spray can would run about $13.
People in
a small town in Western Canada are so fed up with the rotten state
of their main road that they came up with an unusual form of protest
-- a calendar that shows them posing nude in the potholes. One
inhabitant of Leader, Saskatchewan, is shown sitting in a canoe
that is perched in a pothole. Another has his dignity preserved
by a well-placed camera while a third man covers up with a strategic
hubcap. "The initial impression when people open the calendar
for the first time is 'Oh my God!'
It's pretty
dramatic," said Wayne Elhard, the local member of the provincial
legislature. Leader, a town of just 1,000 in a largely farming
area of southwest Saskatchewan, says it can't afford to fix all
its roads. "The potholes are not small, one-foot diameter potholes.
They are many feet across and sometimes they're as deep as a foot
deep and sometimes they will stretch for yards (meters)," Elhard
told CBC television on Wednesday. He said that, over the summer,
local authorities had covered the worst stretch of the main road
with gravel to improve safety. "It's been a constant problem.
We've raised it with the (provincial) government every opportunity
we had ... all to no avail, frankly," he said.
Conservative
Rabbis Reconsider Stance on Gay Sex December
2006
After years
of debate, the Conservative Jewish movement is on the verge of
redefining its approach to homosexuality, a pivotal decision for
a movement that occupies a shrinking middle ground between Orthodox
and Reform Judaism.
Although the
answers have not been made public, Conservative leaders said that
two defend the traditional position that Leviticus 18:22 -- "Do
not lie with a man as one lies with a woman; it is an abomination"
-- prohibits homosexuality between men and, by extension, between
women. The other three proposals offer various arguments for reinterpreting
that prohibition. On a practical level, they could open the way
for Conservative rabbis to perform same-sex commitment ceremonies
and for Conservative seminaries to ordain openly gay rabbis. "I
think the committee is deeply divided -- like the rest of society
is divided, like our movement is divided," said Rabbi Joel H.
Meyers, executive vice president of the Rabbinical Assembly, the
main association of Conservative rabbis. "But the tension has
grown to the point that the committee is hard-pressed to give
some clear guidance to the movement."
Some leading
Christian conservatives, angry over the Global Fund to Fight AIDS's
promotion of condoms and its perceived lack of support for faith-based
programs, are pushing Congress to cut US support for the AIDS
initiative.
This year,
Congress sent $545 million to the fund, $245 million more than
President Bush requested. Nonetheless, Brandt said he wants the
government to eliminate all spending on the Global Fund's HIV
programs because it is not providing sufficient money to faith
groups and has given little support to abstinence messages.
